In 2005 Amnesty International published the report 'Seeking asylum is not a crime', which contains the stories of many individuals, including Jean. The very notion of asylum has been denigrated by populist politics in thought, word and deed. And this is not just far right politics but that of Government and mainstream opposition. Further, asylum seekers have been demonised in parts of the media and, perhaps more startlingly, under-protected by law. Everyone detained is entitled to bring speedy challenge to the lawfulness of their incarceration in court and to release and compensation in the case of unlawful detention. The evasion of taxes owed under law is criminal behaviour, as is giving fraudulent answers on a tax questionnaire. Those arrested under the suspicion of crime justification are promptly to be brought before a judge and are entitled to trial within a reasonable time or bail.
