For a full understanding of the factors and conditions shaping EU
environmental policy, the analysis of central actors and institutions in the previous chapter constitutes an important, but not a
sufficient starting point. In this chapter, we will complement this
picture by focusing upon the characteristic processes and decision-making procedures in the development and design of EU
environmental policies. Of particular significance here are not
only formal decision-making rules and procedures, but also
The Irish health system is confronted by a range of challenges, both emerging and recurring. In order to address these, it is essential that spaces are created for conversations around complex ethical and legal issues. This collection aims to provide a basis for ongoing engagement with selected issues in contemporary Irish health contexts. It includes contributions from scholars and practitioners across a range of disciplines, most particularly, ethics, law and medicine. The focus of the collection is interdisciplinary and the essays are situated at the intersection between ethics, law and medicine. Important issues addressed include admission to care homes; assisted suicide; adolescent decision-making; allocation of finite resources; conscientious objection; data protection; decision-making at the end of life; mental health; the rights of older people; patient responsibilities; stem cell research; the role of carers; and reproductive rights. From these discussion, the collection draws out the following interlinking themes, addressing difference; context and care; oversight and decision-making; and, regulating research. The essays are theoretically informed and are grounded in the realities of the Irish health system, by drawing on contributors’ contextual knowledge. This book makes an informed and balanced contribution to academic and broader public discourse.
This book is about the lives of refugee women in Britain and France. Who are they? Where do they come from? What happens to them when they arrive, while they wait for a decision on their claim for asylum, and after the decision, whether positive or negative? The book shows how laws and processes designed to meet the needs of men fleeing political persecution often fail to protect women from persecution in their home countries and fail to meet their needs during and after the decision-making process. It portrays refugee women as resilient, resourceful and potentially active participants in British and French social, political and cultural life. The book exposes the obstacles that make active participation difficult.
According to this book, Romania's predatory rulers, the heirs of the sinister communist dictator Ceauşescu, have inflicted a humiliating defeat on the European Union. The book argues that Brussels was tricked into offering full membership to this Balkan country in return for substantial reforms which its rulers now refuse to carry out. It unmasks the failure of the EU to match its visionary promises of transforming Romania with the shabby reality. Benefiting from access to internal reports and leading figures involved in a decade of negotiations, the book shows how Eurocrats were outwitted by unscrupulous local politicians who turned the EU's multi-level decision-making processes into a laughing-stock. The EU's famous ‘soft power’ turned out to be a mirage, as it was unable to summon up the willpower to insist that this key Balkan state embraced its standards of behaviour in the political and economic realms. The book unravels policy failures in the areas of justice, administrative and agricultural reform, showing how Romania moved backwards politically during the years of negotiations.
This book attempts a systematic comparison of Japanese and British climate policy and politics. Focusing on institutional contrasts between Japan and Britain in terms of corporatist or pluralist characteristics of government-industry relations and decision-making and implementation styles, it examines how and to what extent institutions explain climate policy in the two countries. In doing this, the book explores how climate policy is shaped by the interplay of nationally specific institutional factors and universal constraints on actors, which emanate from characteristics of the global warming problem itself. It also considers how corporatist institutional characteristics may make a difference in attaining sustainable development. Overall, the book provides a set of comparisons of climate policy and new frameworks of analysis, which could be built on in future research on cross-national climate policy analysis.
This book is concerned with the interaction of traditional politics, culture and voluntary groups, of local and national influences, of ideals and individuals. It looks at local government, social groups and housing policy in the twentieth century. Manchester is the focal point, providing the type of specific detail that only single-city studies can supply. Studying housing provides the most dynamic of all policy areas. The book is divided into three sections, providing it with a structure which highlights the overarching narrative and key themes. The first section looks at some of the main aspects of national policy and legislation across the twentieth century and how these were then interpreted by different local authorities. It shows that while central government provided a lead, encouraging a common approach, national policy was only ever generalised. Cities continued to produce policies specific to their own areas, highlighting the continuing importance of locality in studying the decision-making process. The second section examines the rise of municipal housing in Manchester, looking at the creation and influence of civic culture on the council. In contrast, although the third section considers the continuing influence of civic culture on policy after 1960, it also highlights the decline of municipal legitimacy from the late 1960s. It looks at how tenant frustration gave rise to angry outbursts and organised protests, leading to a challenge to council authority and forcing a change to the decision-making process.
This book introduces international bureaucracy as a key field of study for public administration and also rediscovers international bureaucracy as an essential ingredient in the study of international organizations. Firstly, the book systematically compares behavioural dynamics within a carefully selected number of international bureaucracies. The focus is on studying these dynamics within international bureaucracies at the actor level - that is, by studying the behaviour and roles as perceived by the officials themselves. The book outlines a conceptual map of four generic behavioural dynamics that are likely to be evoked by these officials: intergovernmental, supranational, departmental and epistemic dynamics. Essentially, the Westphalian international order dominated by the intergovernmental dynamic is challenged to the extent that international bureaucracies embed supranational, departmental and epistemic dynamics in everyday decision-making processes. Admittedly, there are no guarantees that these dynamics always materialise in the actors' behaviour and ultimately in the decisions reached by international organisations. However, they serve as cognitive and normative frames for action, rendering it more likely than not that particular decision-making dynamics are associated with certain behavioural patterns. Secondly, the book illuminates some causal factors that may help to explore the conditions under which different behavioural dynamics are manifested in the behavioural and role perceptions of the incumbents of international bureaucracies. Essentially, the authors do not propose to 'test' the four dynamics outlined above in a rigorous manner. They serve more as 'searchlights for illuminating empirical patterns in our data'.
This book a study on the work of the Eurogroup—monthly informal meetings between euro area finance ministers, the Commission and the European Central Bank. It demonstrates how this small, secretive circle of senior decision-makers shapes European economic governance through a routinised informal policy dialogue. Although the role of the Eurogroup has been contested since before the group's creation, its actual operation has never been subject to systematic evaluation. This book opens the doors of the meeting room and shows how an understanding of the interplay of formal provisions and informal processes is pivotal to the analysis of euro area governance. The book advances the conceptual understanding of informal negotiations among senior European and national decision-makers, and provides an in-depth analysis of historical episodes of policy coordination. As other areas of European decision-making rely increasingly on informal, voluntary policy coordination amongst member states, the Eurogroup model can be seen as a template for other policy areas.
Cooperation and trust were increasingly scarce commodities in the inner councils
of the EU. This book explores why the boldest initiative in the sixty-year quest
to achieve a borderless Europe has exploded in the face of the EU. A close
examination of each stage of the EU financial emergency that offers evidence
that the European values that are supposed to provide solidarity within the
twenty eight-member EU in good times and bad are flimsy and thinly distributed.
The book aims to show that it is possible to view the difficulties of the EU as
rooted in much longer-term decision-making. It begins with an exploration of the
long-term preparations that were made to create a single currency encompassing a
large part of the European Union. The book then examines the different ways in
which the European Union seized the initiative from the European nation-state,
from the formation of the Coal and Steel Community to the Maastricht Treaty. It
focuses on the role of France and Germany in the EU. Difficulties that have
arisen for the EU as it has tried to foster a new European consciousness are
discussed next. The increasingly strained relationship between the EU and the
democratic process is also examined. The book discusses the evolution of the
crisis in the eurozone and the shortcomings which have impeded the EU from
bringing it under control. It ends with a portrait of a European Union in 2013
wracked by mutual suspicions.
Why adopt a poststructural perspective when reading about the military strategy of national missile defence (NMD)? Certainly, when considering how best to defend the United States against attack by intercontinental ballistic missiles, the value of critical international relations theory may be easy to overlook. So, how might the insight of scholars such as Michel Foucault contribute to our understanding of the decision-making processes behind NMD policy? The deployment of NMD is a sensitive political issue. Official justification for the significance of the NMD system is based upon strategic feasibility studies and conventional threat predictions guided by worst-case scenarios. However, this approach fails to address three key issues: the ambiguous and uncertain nature of the threat to which NMD responds; controversy over technological feasibility; and concern about cost. So, in light of these issues, why does NMD continue to stimulate such considerable interest and secure ongoing investment? Presented as an analysis of discourses on threats to national security – around which the need for NMD deployment is predominately framed – this book argues that the preferences underlying NMD deployment are driven by considerations beyond the scope of strategic approaches and issues. The conventional wisdom supporting NMD is contested using interpretive modes of inquiry provided by critical social theory and poststructuralism, and it is suggested that NMD strategy should be viewed in the context of US national identity. The book seeks to establish a dialogue between the fields of critical international relations theory and US foreign policy.
